Voluntary Departure Period 2018.10.1 ~ 2019.03.31 A.

Ang MInistri ng Hutisya (Ministry of Justice) ay magpapatibay ng panukalang-batas laban sa ileggal na trabaho sa mga industriya tulad ng mga constructions o adult entertainment at massage, kung saan ang pagpasok sa domestic market ng trabaho pati na rin ang impediment sa pagkakabahala sa kultura ng Korea
 Ang mga kabilang na mga parusa ay ang suspensyon ng mga negosyo, ay pinlano na pagpapataw na parusa sa mga ahensya na nagbibigay ng trabaho sa mga dayuhan.
B. Ang mga banyagang nahuling illegal na nagtatrabaho sa industriya konstruksyon ay agad pauwiin kahit anong pinahihintulutang panahon na panantili (kahit may legal na bisa) ito ay ang patakaran "One strike out"
 Ang patakaran na "One strike out" ay pantay na inilalapat sa lahat ng dayuhan, kabilang ang mga dayuhang estudyante, mga miyembro ng pamilya sa mga imigranteng kasal sa Koreano at sa ibang Koreans na galling sa ibang bansa na ilegal na nagtatrabaho sa mga larangan ng industriya na binanggit sa itaas
C. Ang mga dayuhan na hindi umuwing kusang-loob at nahuli sa crackdown it ay agad pauuwiin at maaaring ipaadala ang kanilang impormasyon at maabisuhan ang kanilang gobyerno ng kanilang sariling bansa

D. Ang boluntaryong pag-uwi ay mula : Oktubre 1 2018 - Marso 31, 2019 Ang kusang-loob na umuwi na mga dayuhan sa loob na mga panahong ito at ganno man katagal na panahon ang kanilang pagiging ilegall ay hindi maisasailalim sa regulasyon pagpasok (ban entry regulations),
 Ang mga dayuhang nahuli sa crackdown ay isasailalim sa mga regulasyon sa entry(ban entry regulations) para sa isang maximum na 10 taon at maaaring maabisuhan ang pamahalaan ng kanilang sariling bansa
Upang Iulat ang mga iligal na dayuhan na tumawag sa 1588-7191

Pagkamatay ( Impormasyon para sa mga Manggawa dito sa Korea)

Alamin ang dahilan ng pagkamatay - Alamin ang dahilan ng pagkamay at tiyakin ang pangalan ng nakatalaga sa punerarya sa Korea, gayundinang bilang ng telepono
Makipag-ugnayan sa Embahada upang mas mapadali matanggap na suporta
Iba’t ibang tulong mula sa insurance at mga maaring matanggap na suporta
A. Kung dahilan ng pagkamatay ay industrial accident , sagutan ang applicaton form at saka isumite ( Korea Worker’s Compensation & Welfare Service)
B. Sakaling hindi maaprubahan ang industrial accident , maaring makatanggap ng tulong para sa pagkamatay dahil sa sakit o pagkamatay dahil sa aksidente ng dayuhang manggagawa sa pamamagitan ng accident insurance (Samsung Fire)
C. Sakaling nakasuskrito ang negosyo , ang mga kapamilya ay maaring makatanggap tulong mula sa National Pension Service)
D. Kung ang pagbabayad ay sa pamamagitan ng bangko , at mayroong mahigit sa 500 dollars ang naipadala sa nakalipas na 3 buwan, awtomatikong nakasuskrito na sa accident insurance at maaring alamin ang regular na benepisyong maaaring makamit sa pamamgitan ng bangkong pinapadalhan
E. Para sa aksidente sa trapiko, dapat na alamin ang insurance ng sangkot na ssakyan at napinsalang sasakyan kasama na rin ang mga representatibo, bagaman maaring pagpasyahan mga klasipikasyon ng kompensasyon maari pa ring hingin ang tulong ng abogado na eskperto sa aksidente sa trapiko
F. Para sa kaso ng pagkamatay bilang resulta ng kriminal na aktibidad, ang may sala ang responsible sa lahat ng bagay at kung walang kompensasyon na maaring matanggap , maaring makipag ugnayan ang biktima sa Public Prosecutors Office para sa criminal damage compensation claim (Principle of Reciprocity )
 
 
Mga kina kailangan Dokumento para sa Insurance Claim Application form , death certificate o postmortem report, pasaporte o kopya ng alien registration certificate, kopya ng bankbook ng itinalagang represtantibo , notaryadong power of attorney sa wikang Ingles , katibayan ng pagiging legal na tagapagmana ayon sa itinalaga ng pamahalaan ng bansang pinagmulan (isama ang birth certificate o marriage certificate)
 
 
Insurance Claim Payment Due Date Sa pagtatapos ng imbestigasyon sa aksidente at kung walang anumang abala sa insurance application , matatangap ang kabayaran 3 araw matapos na maisumite ang applikasyon
Para sa karagdagang imbestigasyon at kumpirmasyon , maaring magkaroon ng delay 50% ang paunang maging kabayaran .

Pagkatanggal sa Trabaho ( Info for EPS)

  • (Limitasyon ng Dismissal) HIndi maaring tanggalin sa trabaho (one sided) ang sinumang manggagawa nang walang kaukulang dahilan .
  • Hindi maaring tanggalin ng employer sa trabaho (one sided) ang mga manggagawa nang walang kaukulang dahilan
  • (Mga Kaukulang Dahilan) pagliban at pagkahuli ,pagtanggi sa trabaho ,kriminal na aktibidad, pandaraya o ibang hndi katanggap -tanggap (unethical) na pag-uugali
  • Sa mga sumusunod na panahon ay hindi kailanman maaring magtanggal sa trabaho , at sakaling natanggal sa trabaho ay maaring makatanggap ng tulong dahil sa naransan na hindi makatarunggang pagkatanggal sa trabaho
- pagkakasakit dahil sa trabaho * level dahil sa pagpapagamot at 30 araw matapos nito
- maternity leave at 30 araw matapos nito
- panahon ng parental leave
  • Sakaling matanggal sa trabaho dahil sa usapin ng kumpanya ,kahit pa ang kaso ng dismissal ay dahil sa negosyo ,kailangan pa rin itong sumailalim sa karampatang kahingian (requirements) at pamamaraan
- Sakaling tinanggal ng employer ang isang manggawa dahil sa usapin ng negosyo ,kailangang magkaroon ng paalal 30 araw bago nito ,na magbayad ng bahagdan na 30 araw bago nito ,marapt na magbayad ng bahagdan na 30 araw na higit sa regular na sweldo ang marapat na ibayad.
  • (Unfair Dismissal Solution) Para sa mga kumpanyang may 5 manggawa o higit pa kung saan naganap ang unfair dismissal , maaring magsumite ng reklamo sa Regional Labor Relations Commission , habang maari namang magsampa ng kaso laban sa mga kumpanyang may hindi lalampas sa 5 ka tao
- Kinakailangan na maisumite sa Regional Labor Relations Commission ang kaso sa loob ng 3 buwan simula nang maganap ang insidente, gaya ng undair dismissal
- Maaring muling makabalik (reinstatement) sa orihinal na pinagtrabahuhang kumpanya sakaling kinilala ang unfair dismissal , at kung hindi naman ninaais namuling makabalik sa trabaho ay maaring makatanggap ng kabayaran sa panahon na natanggal sa kumpany.
  • Unfair Dismissal Procedures ( Kumpanyang may 5 o higit pang manggagawa)
  • Kailangan ng konsultasyon kasama ang labor experts hinggil sa unfair dismissal kaugnay ng mga usapin para sa tulong na kinakailangan -> P agsusumite sa Regional Labor Relations Commission ng report para sa unfair dismissal at relief application at application from -> Bubuksan ang pagpupulong sa pamamagitan ng Regional Labor Board at pagpapasyahan ang hinggil sa unfiar dismissal at saka iuutos ang muling pagpapabalik sa trabaho (reinstatement) o pagbibigay ng kumpensasyon -> Sakaling hindi naipatupad ng employer ang pinal na kautusan magkakaroon ng karampatang multa na KRW 20 milyon

l  Proseso para Maresolba ang Hindi Nabayarang Sahod
I-             report sa Ministry of Employment and Labor ang ukol sa hindi nabayarang sahod, kung saaan may kaugnay na proseso gaya ng sibil na paglitis (civil litigation), at sakaling magdeklara ang kumpanyang pagkalugi (bankruptcy), maaring ipatupad ang substitute payment.

Mga Pamamaraan – Isinusumite ang reklamo sa Ministry of Labor at ang mga employer ay inaatsan ng Labor Inspector na bayaran ang kaukulang sahod at kabayaran para sa criminal offense para sa tinamong psychological pressure bilang remedy sa hind nabayarang sahod – Sa pagsasampa ng kaso sa korte,maaring matanggap ang sahod sa pamamagitan ng preservative measuers.

Bentahe - * Maaring maging mabilis ang pagkakaayos * Higit na mura at simpleng pamamaraan – Maaring gumamit ng compulsory execution upang masiguro ang wage claim para sa pagkuha ng hindi nabayrang sahod
Disbentahe - * Mahirap na kaso ito sakaling walang kakayanan ang employer na bayaran ang sahod * Upang maresolba ang kaso,magkakaroon ng substitute  payment sakaing mag-file ng bankruptcy ang kumpanya – Masyadong gumugugol ang panahon at salapi

-       (Petisyon) Paghiling ng karamptang parusa para sa mga employment dahil sa paglabag sa Labor Standards Act

-       Imbestigasyon hinggil sa katotohanan ng pangyayari -> Pagpapasya hinggil sa hindi nabayarang sahod -> Pamamaraan ng pagbabayad -> Paghahabla ng kasong sibil sakaling hindi magbayad ng sahod ang employer
