Foreigners and Coverage

Foreigners residing in Korea are subject to the compulsory coverage of the National Pension Scheme, just like Korean nationals. So, if a foreigner aged between 18 and 59 is working at a workplace covered under the scheme, he/she shall be a Workplace-based Insured Person, or an Individually Insured Person compulsorily.
Exclusions from the National Pension Coverage
  • 1. Any national whose country’s pension system does not mandatorily cover Korean citizens.(The Republic of South Africa, Nepal, Maldives, Myanmar, Bangladesh, Vietnam, Saudi Arabia, Armenia, Swaziland, Ethiopia, Iran, Egypt, Tonga, Pakistan, Fiji, Cambodia, Singapore, Belarus, East Timor, and Georgia, Nigeria and Malaysia do not mandatorily cover Korean citizens under their pension schemes)
  • 2. Foreigners who are not registered according to the Immigration Act, or to whom a forced deportation order has been issued under the same Act, or who are staying in Korea without being permitted to extend their terms of sojourn.
  • 3. Foreigners whose stay status is applicable to any of the following: D-1, D-2, D-3, D-4, D-6, F-1, F-3, or G-1
  • 4. Foreigners who is excluded from the National Pension Coverage By the Social Security Agreement.
Aquisition & Loss of Insured Status has to be reported
  • Who should submit reports regarding acquisition & loss of insured status?
    For Workplace-based Insured Foreigners : The employer.
    For Individually Insured Foreigners : The foreigner.
  • - Reporting Due Date :
    By the 15th of the next month of the date of acquisition & loss of insured status. For example, if an employee starts working in February, the employer has to make a report by March 15.

Foreigners and Payment of the Lump-sum Refund

Foreign insured persons are treated equally as Korean insured persons under the National Pension Scheme. If a foreign insured person fulfills eligibility to receive an Old-age, Survivor or Disability pension, he/she can be paid any of the pension benefits on the basis of the Korean National Pension Act.
There is no discrimination in terms of benefit amounts and remitting benefits abroad, etc. But there is a certain distinction regarding a Lump-sum Refund. In principle, a Lump-sum Refund is not paid to foreigners leaving Korea after having been covered under the scheme.
But, to foreigners falling under any of the following conditions, a Lump-sum Refund will be paid.
  • 1.In cases where a foreigner whose home country grants Koreans benefits in compliance with a Lump-sum Refund under the National Pension Scheme. (Article 126 of the National Pension Act and Article 113 of the Enforcement Decree of the National Pension Act) ※as of June 2015 : 24 countries(Belize, Grenada, Jordan, Saint Vincent and Grenadine, Zimbabwe, Cameroon, Thailand, Bhutan, Ghana, Sri Lanka, Bermuda, Malaysia, El Salvador, Indonesia, Kenya, Kazakhstan, Hong Kong, Trinidad and Tobago, Sudan, Columbia, Vanuatu, Philippines, Tunisia and Uganda)
  • 2.In cases where a foreigner whose home country has concluded a social security agreement with Korea regarding the payment of the Lump-sum Refund ※As of June 2015: 16 countries (Canada, United States, Germany, Hungary, France, Australia, Czech Republic, Belgium, Bulgaria, Slovakia, Poland, Romania, Austria, India, Turkey, Swizerland)
  • 3.Regardless of the nationality, in cases where a foreigner, who has been covered under the National Pension Scheme with the status of sojourn of E-8 (Employment for Training), E-9 (Non-professional Employment), or H-2 (Visiting Employment), returns to his/her home country
Effective from May 11, 2007
If a person had stayed in Korea with 2 or more types of status of sojourn, only the contributions paid during the insured period with those status (E-8, E-9, H-2) are returned.
If a foreigner applies for a Lump-sum Refund because he/she is going to return to his/her home country, the Lump-sum Refund will be paid as long as NPS is able to verify that the person has left Korea. However, if he/she submits the required materials, such as an airplane ticket verifying his/her departure within one month, he/she will be able to apply for the refund before leaving Korea.
The amount of a Lump-sum Refund is the sum of the contributions paid and interest gradually increased. The interest rate is the rate from the involved period of a time deposit with a maturity of three years.

                            How can foreigners apply for a Lump-sum Refund?
① Applying before departing from Korea (for applicants in Korea)
The insured person has to visit one of our local offices with the following documents:
<Required documents>
  • An application for Lump-sum Refund (This form is available at any local office.)
  • Passport of the insured person
  • Alien registration card of the insured person
  • Proof materials of the insured person’s bank account (such as a bank statement, voided check, or bankbook showing the applicant’s name and account number, etc.)
  • Flight (or ship) ticket (the date of departure has to be within a month from the date of application)
② Applying after departing from Korea (for applicants outside of Korea)
An application can be made by an agent or mail.
(1) Application by mail from abroad
The applicant has to fill out the forms and send them with the required documents. Before mailing the application, the applicant needs to have the whole application notarized by a notary public and then apostilled (or attested by the local Korean consulate).

A copy of the passport of the insured person
Proof of the insured person’s bank account (such as a bank statement, voided check, or bankbook showing the applicant’s name and account number, etc.)
In the case of overseas remittance: application for overseas remittance is additionally required.
(2) Application from abroad by an agent in Korea
An agent in Korea may visit one of our local offices with the required documents and apply for the benefit in place of the beneficiary who is staying abroad. In this case, the benefit is transferred to the beneficiary’s bank account.
<Required documents>
An application for a Lump-sum Refund: the beneficiary has to fill out the "Application by Agent" section of the application form and have the application notarized by a notary public in his/her country and then apostilled (or attested by the local Korean consulate).
Instead of filling out the "Application by Agent" section, the beneficiary may send a letter of attorney which indicates the agent’s information: full name and address. The letter of attorney has to be authenticated by a notary public in the country where the beneficiary lives and then apostilled (or attested by the local Korean consulate). The agent living in Korea who has received the letter of attorney may have to attest the letter after translating it into Korean so the letter's contents can be generally recognized.
A copy of the beneficiary's ID card (issued by the government of the beneficiary's home country, such as a passport, or other forms of identification)

Proof of the beneficiary’s bank account (such as a bank statement, voided check, or bankbook showing the beneficiary’s name and account number, etc.)
In the case of overseas remittance: application for overseas remittance is additionally required.
If any government administrative agency of a foreign country certifies that the "Application by Agent" part of the application (or the letter of attorney) is written by the beneficiary, and the Embassy of the foreign country in Korea attests it, then the notarization and apostillation (attestation) of the application (letter of attorney) and the proof of the beneficiary’s bank account is not required.
(3) Application through MOU
A foreign national who has returned to his/her home country may submit an application for a Lump-sum Refund, Lump-sum Death Payment or unpaid benefits of the two, at the social insurance institution of his/her home country that has concluded an MOU on benefit applications with NPS. The social insurance institution will send the applications to NPS. Then NPS pays the benefit and sends a notice of payment to the applicant directly.

                         Payment Service of a Lump-sum Refund for Foreigners at the Incheon Airport

NPS is providing payment service for foreigners who leave Korea through the Incheon Airport
  • 1. Payment at the airport is appropriate only when the beneficiary leaves on a flight from 11:00 to 24:00, Mon to Fri. (not available on official holidays) and the ex-employer of the insured person makes a disqualification report to NPS at least one day before the departure date. The insured person has to visit one of the local offices within a month of departure and apply for a Lump-sum Refund. The insured person can choose the airport payment as the method of payment.
  • 2. Payment Procedure at the airport
    · Application at the local offices (Office hours 09:00~18:00)
    • Visit one of our local offices and apply for a Lump-sum Refund
    • Select [Airport Payment] as the method of payment
      Required Documents: passport and alien registration card of the insured person, flight ticket with a departure date within a month, and proof of the beneficiary’s bank account (in case there is an additional payment or failure of airport payment)
    • Receive a ‘Filing Receipt’
· Receipt at Incheon Airport
  • At Incheon Airport Office (Office hours 09:00~17:00), on the departure date, hand in the filing receipt, passport, alien registration card and flight ticket, and receive the "Direction for Payment of a Lump-Sum Refund"
  • At ACE Foreign Exchange Booth of Shinhan Bank (Office hours 09:00~17:30) Hand in the "Direction for Payment of Lump-sum Refund" and passport, and receive the “Receipt of Currency Exchange.”
  • At Dojeon Foreign Exchange Booth of Shinhan Bank (in front of the 43th boarding gate; office hours 09:00~21:00) Hand in “Direction for Payment of a Lump-Sum Refund,” "Receipt of Currency Exchange" and passport, and withdraw the exchanged money

 Gabay sa Aplikasyon ng Claim para sa “Occupational Health & Safety Insurance” (“Sanjae Bohum”) ng mga Dayuhang Manggagawang Pauwi na sa Kanyang Bansa


○ Ano ang “Occupational Health and Safety Insurance” (“sanjae bohum”)? 

- Ito ay sistema ng social insurance sa Korea kung saan ginagamit ang perang mula sa “sanjae bohum” upang maipagamot ang mga manggagawang naaksidente o nagkasakit dahil sa pagtatrabaho at kinakailangang magpagamot sa loob ng apat (4) na araw o higit pa. Ang insurance ay inilalaan din para mabayaran ang 70% ng average na sweldo habang sila’y nagpapagamot at hindi makapagtrabaho. Ginagamit din ang insurance na ito kapag namatay ang manggagawa upang maibigay ang benepisyo para sa pamilya ng pumanaw. - Ang lahat ng mga dayuhang manggagawa, kahit na sila’y legal o ilegal, ay maaaring mag-apply at makatanggap ng benepisyo mula sa “sanjae bohum” gaya ng mga Koreano. - Kapag ang sintomas ng sakit ay naranasan matapos nang makauwi sa Pilipinas, maaari pa ring mag-apply at makatanggap ng benepisyo mula sa “sanjae bohum” sa HRD Korea EPS Center sa Pilipinas.

○ Proseso ng aplikasyon para sa “Sanjae bohum” ng mga dayuhang manggagawang nakauwi na 

- Matapos magpakonsulta ng dayuhang manggagawa sa HRD Korea EPS Center, sagutan ang “medical care application form” na makikita sa sentro at saka ito isumite. (EPS Center → Korea Workers’ Compensation and Welfare Service (“COMWEL”)) - Isasagawa ng COMWEL ang pagsusuri tungkol sa detalye ng tinamong aksidente, uri ng trabaho at iba pa. At saka nila pagpapasiyahan kung iyo ba ay maituturing na aksidente sa pagtatrabaho (“work-related accident”). - Isulat nang detalyado ang mga sumusunod: ① Petsa ng unang pagpasok sa kumpanya, oras ng pagtatrabaho, bilang ng araw ng pagtatrabaho sa loob ng isang linggo, panahon ng pagtatrabaho, ② oras ng pagpapahinga, oras ng pagkain, ③ detalye tungkol sa mga dating pinagtrabahuhan (pangalan ng kumpanya, tungkulin sa kumpanya (uri ng trabaho), panahon ng pagtatrabaho), ④ taas, bigat (height, weight), ⑤ ilista kung anu-ano ang mga dating naging sakit o kung may aksidenteng dating natamo, ⑥ madalas na isagawang ehersisyo at libangan, ⑦ isulat kung naninigarilyo at/o umiinom ng alak, ⑧ detalye ng trabaho (sa bawat oras), ⑨ detalye ng natamong aksidente o detalye ng nararanasang sintomas, ⑩ personal na impormasyon ng saksi, ⑪ pinuntahang medikal na institusyon matapos maranasan ang sintomas, ⑫ alamin kung may nararanasan ding katulad na sintomas ang ibang katrabaho, ⑬ kung may natanggap kayong bayad para sa pagpapagamot o sahod sa mga araw na hindi nagtatrabaho mula sa inyong kumpanya. Matapos itong maisulat sa application form, saka ito isumite.

A. Pagsusumite ng “Medical Care Application Form” (Manggagawa → EPS Center)
B. Pagsusuri tungkol sa aksidente
C. Pagpapasiya kung ito ba ay aksidente sa pagtatrabaho
D. Pagbibigay ng notipikasyon tungkol sa resulta ng inaapply na medical care (EPS Center →Manggagawa)
○ Uri ng mga Benepisyo mula sa Insurance

1 Sa pagsasagawa ng pagsusuri tungkol sa aksidente, kinakailangan nilang tiyakin sa employer at sa manggagawa ang detalye tungkol sa pagtatrabaho at maaari rin silang humingi ng kaugnay na dokumento para rito. Kaya naman maaaring maantala ang pagbibigay ng desisyon dahil dito. 2 Kapag nag-apply para sa medical care para sa sakit na nakuha dahil sa pagtatrabaho, ang “Occupational Diseases Deciding Council” ang magpapasiya kung ito ba ay matuturing na sakit dahil sa pagtatrabaho

Guide to the National Pension for Foreigners

About the National Pension Scheme 

* The National Pension Scheme is a Social Security System implemented by the Korean government to ensure a stable livelihood by collecting contributors and paying pension benefits for the insured or their dependents, and to prepare for retirement or unexpected calamities such as disability and death,.

Compulsory Coverage of the National Pension Scheme 

* Like Korean nationals, foreigners aged between 18 and 60 who reside in Korea are subject to the compulsory coverage of the National Pension Scheme .
Foreigners whose countries do not cover Korean nationals under their public pension scheme, however are excluded from coverage under the NPS.
* Despite the above provisions ,if there are relevant provisions under the Social Security Agreement between Korea and any foreign country , those provisions will be applied.

Countries exempted from the National Pension (20 Countries)

* South Africa, Nepal , The Maldives , Myanmar , Bangladesh , Vietnam , Saudi Arabia , Singapore , East Temore , Armenia , Ethiopia , Egypt , Tonga , Pakistan , Fiji , Cambodia , Belarus , Georgia , Swaziland,

Payment Contributions 

* For workers the employees and their employers should each make contributions for the employees amounting to 4.5 % of the standard monthly income respectively , based on the employees earned income for a total l contributions of 9 % of the employees monthly income.
* Individually Insured Persons should make contribution amounting to 9 % of their reported standard monthly income.
* There is no discrimination in terms of the contribution rate between foreigners and Korean . The payment should made no later than the 10th day of the following month .

Benefits

* If foreign insured persons are entitled to an Old-age, Disability , or Survivor Pension , they will receive pension benefits according the the same standards Korean nationals.

A) Old-aged Pension
- The Old -aged Pension is paid monthly to those whose insured period is 10 years or more and are over 60 years old. However, beginning with people born between 193~56 and continuing in 4 years blocks, the pensionable age will incrementally increase by 1 year until it reaches a maximum of 65 years of age for people born in, and after 1969 .

B) Disability Pension
- The Disability Pension is paid to those with a disability after the treatment of diseases or injuries incurred during the insured period , according to the degree of their disability . Annuities will be paid to those with 1st, 2nd, and 3rd Degree of their disabilities and lump-sum benefits will be paid to those with 4th degree disabilities.

C) Survivor Pension 
- If currently insured persons or pensioners are deceased , a Survivor Pension will be paid every month to their surviving dependents whose livelihood was supported by the deceased person.

D) Lump-Sum Refund 
- In principle , a lump-sum refund is not paid to foreigners . However in the case of foreigners meeting any any of the following criteria, when they leave Korea or reach the age of 60, a lump - sum refund equivalent to the amount of contributions paid plus the fixed interest is paid to them, or to their survivors if they should die.

1 A foreigner whose home country has concluded a social security agreement with Korea to secure benefit rights by combining the insured period in each sountry.
       2. A foreigner whose country grants Koreans a benefits corresponding to a Lump-sum refund.    
   
        3. A foreign workers whose visa is either E-8 (Employment for Training) E-9 (Non -proffesional Employment , or H-2 (Visiting Employment)


Countries eligible for lump-sum refunds (44countries)

- Via Reciprocity: Belize , Grenada , Nigeria  , Barbados , Saint Vincent , and Grenadine, Zimbabwe , Cameroon, Congo, Thailand, Togo, Venezuela, Ghana, Malaysia, Vanuatu, Bermuda, Sudan, Sri-Lanka, Switzerland, El Salvador , Jordan , India , Indonesia ,Kazakhstan, Kenya , Trinidad  and Tobago, The Philippines, Hong-Kong, Turkey , Columbia, Tunisia , Uganda , Bhutan,

- By Agreement: Germany , U.S , Canada, Hungary , France , Australia , Czech Republic , Belgium, Poland , Slovakia, Bulgaria, Romania , Austria

Application for the Lump- Sum Refund
* Applying in Korea (before departing Korea) :
- Application Form , a copy of ID card ( passport , Alien Registration Card)bankbook, plane ticket,
* Applying overseas (after departing Korea): Application form (notarized by a notary agency of the country in which you reside and attested to by the Koran Consulate or Embassy ) A copy of passport , A copy of bankbook
- When you apply for a lump-sum refund through an agent in Korea, the application must be submitted only by mail in order to avoid extra administration fees and incorrect or false applications
- It is possible o apply for a lump-sum refund through the agency in a contacting country
(including 14 countries : Germany , U.S , Canada, Hungary , France , Australia , Czech Republic , Belgium, Poland , Slovakia, Bulgaria, Romania , Austria,India)

APPLICATION FOR LUMP-SUM REFUND AT THE AIRPORT

* Who can apply: A foreigner who is schedules to depart for his own country through Incheon International Airport within a month of his/her application
- Airport Payment is applicable only if the flight's departure time is between 11:00 through 24:00 on weekdays
- After applying for the Lump-sum Refund at NPS regional branches , receive a " Direction for Payment of Lump-sum refund" from Incheon International Airport Office on the date of departure
-Receive a "Receipt of Currency Exchange"from Shinhan Bank Incheon International Airport office after handing in "Direction for Payment of Lump-sum Refund"
- You will receive the Lump-sum Refund after going through the immigration departure procedure.

Payment of Lump-sum Refund under the MOU (including 4 countries : Mongolia, Uzbekistan , Thailand, Sri-Lanka
* Who can apply: Employees who have paid contributions in Korea but have not applied for lump-sum refunds, returning to their home countries
* Required Documents: A copy of a passport , A copy of bankbook,A copy of ID card (such as passport, Alien Registration Card), MOU Application form (available at a contacting agency

Topic: Maraming Nagtatanong araw-araw tungkol sa EPS ang bawat tanong ay aking pinapadala sa ating Labor Attach Felicitas Bay nang Philippine Embassy at ito ay  tinutuganan ang mga  tanong.

Ang inyo pong email na “Senior Citizen na Kami Kung Tawagin sa KLT” ay pinadala po sa amin nang aming Labor Office sa Seoul, Korea upang aming tugunan.
Ibig po naming ipaalam sa inyo na kami po ay nakipag-ugnayan ke Director General Im Jong-Jin, ang HRD Korea Resident Representative na nakatalaga po dito sa Pilipinas, tungkol po sa inyong concern. Ayon po ke Director Im, tanging ang employer lang po ang namimili nang mga manggagawa na gusto nilang i-hire sa kanilang tanggapan at wala pong control ang HRD Korea sa pagpili nang mga workers na nasa roster. Dagdag pa po ni Director Im na wala pong “bias” pagdating sa edad nang mga manggagawa at lalong hindi sila nagbibigay nang “priority or special treatment” sa mga ito.
 
Nais pa pong ipaalala ni Dir. Im na kahit po kayo ay nakapasa sa EPS-TOPIK, ito po ay hindi nagbibigay nang garantiya na kayo ay makakakuha nang trabaho sa Korea.

NBI CLEARANCE PROCEDURES in SOUTH KOREA (FILIPINO ONLY)

Hi, I am not a good writer but I really loved to share information so bare with me :

How to get NBI Clearance when you're in South Korea ?

Please read below:

First thing to do :

A. For OFW : Bring your Valid Philippine Passport to get your finger print in Philippine Passport

B. For Korean Spouses: Bring your Valid Philippine Passport , ARC ID , Marriage Certificate

1. Send your NBI Application form to your relative or fiend and submit ONLY to NBI main Office , which is located at United Nations Avenue , Ermita , Manila with your authorization letter. Please attach photocopy of your passport as proof of identity. Advise your representative to bring two (2) valid ID's


2. After receiving your NBI Clearance , bring the NBI clearance to the Department of Foreign Affairs (DFA) for Authentication. Please write an authorization letter with  photocopy of your passport as proof of identity. Advise your representative to bring two (2) valid IDs.

* DFA ASEANA near Mall of Asia, Paranaque City
* DFA - Ali Mall in Cubau , Quezon City
* DFA - SM Megamall , Mandaluyong City
* DFA- SM Manila, Manila
* DFA - Metro Gaisano, Alabang
Payment: 100 PHp for 4 working days , 200 Php for 1 day

3. Bring the DFA Authenticated NBI Clearance (with red ribbon) to the Korean Embassy in Taguig for certification since you will use your NBI Clearance in Korea. Write an authorization letter and attach a photocopy of your passport as proof of identity, Advise your representative to bring two(2) valid ID's

4. Inform your representative to send back the document to you.

For natural born Filipino citizens :

1. Application for Retention or Re-acquisition of Philippine citizenship
2. Petition for Retention and Re-acquisition of Philippine Citizenship
3. Six (6)pcs. of 2x2 colored pictures (Front) over white background
4. One (1)pc. of 2x2 colored pictures (left side view) over white background
5. ONE (1)PC OF 2X2 COLORED PICTURES (right side view) over white background
6. Oath of Renunciation Philippine citizenship (3 photocopies)
7. The original and three (3) photocopies of each of the following documents
- NSO Birth Certificate
- NSO Marriage Certificate / Copy of Report of Marriage notarized by the Consul of the Philippine Embassy~ Seoul
- Old Philippine passport ( copy , if still available )
- English translation of the Certificate of Naturalization or Basic Certificate ( kibunjeungmyeongso) indicating the complete record of the former Filipino citizen : date of acquisition of the foreign citizenship and record of name change (if availed in Korea)

For children born with former-Filipino parents:

1. Application Form
2. Six (4)pcs of 2x2 colored pictures (Front) over white background
3. One (1) pc of 2x2 colored pictures (left side view) over white background
4. One (1) pc 2x2 colored pictures (Right side view) over white background
5. The original and three (3) photocopies of each of the following documents
- English Birth Certificate of the child from the hospital
- Foreign Passport
- Apply for a Report of Birth (requirements may be found here)

Fee for the principal applicant :KRW 67,000 /50USD
Fee for each dependent / derivative applicant : KRW 33,550 /25 USD

Additional fees apply for Report of Birth  and ePassport /Travel Document application

Upon receipt of the Order of Approval , Identification Certificate and Oath of Allegiance , the principal applicant may schedule an appointment for the application of an ePassport at the Embassy.

For derivative applicants, they may only apply for a Philippine passport after the parent and the child successfully applied for the R.A 9225 and register the birth of the child at the Embassy .

- The Center holds classes for parents and children . The classes include classes for understanding children, art therapy to gain insight into the minds of children ,making family cake and family trips to Namiseom island.

- The Center operated Dadogim Camp for multicultural children and their families to improve family relations.

4. Incheon Yeonsu Cultural Center
- The Center operates a Saturday culture school as a theatrical class for young adults that is also participated in by parents.

5. Jeonju Young Adult Dream Center
- A special program for multicultural families titled " Sonagi  ( communication,sharing and pleasure )" is operated as a family solution camp. The camp is operated by the Ministry of Justice . Those whose indictment is suspended among multicultural children are preferred and other multicultural children may apply for or be recommended for the remaining quota.
